KindnessFeed

Terms and Conditions

Draft notice

This document is a working draft for legal review and is not yet in force. Replace all bracketed operator details and confirm the operational workflows before publishing.

Communication risks and user responsibility

KindnessFeed may carry out checks on charities, their registration details and representatives, but such checks are limited and do not constitute a guarantee or certification that a charity, representative or user is fully verified, trustworthy, authorised or acting lawfully. Users should independently confirm identities, charitable status, payment destinations and requests, and take appropriate precautions before donating, volunteering, sharing information or arranging meetings. KindnessFeed does not endorse, authorise or indemnify independent acts, statements, commitments or transactions of users or organisations, and accepts no liability for those acts to the extent permitted by applicable law. Nothing in this provision excludes legal responsibilities that cannot lawfully be excluded.

Users and charity representatives communicate at their own discretion and are responsible for their own conduct, statements, commitments and interactions. KindnessFeed is a hosting and communications platform, not a party to arrangements between users or charities. To the maximum extent permitted by applicable law, KindnessFeed disclaims responsibility for losses, disputes or harm arising from independent user conduct or communications. Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable duties regarding unlawful content, safety, privacy or data protection.

Messaging and interacting with people online carries risks, including impersonation, fraud, harassment, pressure to donate, deceptive fundraising links and unsafe meetings. Users should verify identities and charitable claims independently, avoid sharing sensitive personal or financial details, communicate through KindnessFeed where possible, and report suspicious, hateful, threatening or abusive messages. Where abuse or coercion is suspected, stop engaging, use available blocking and reporting options, and contact emergency services where there is immediate danger.

KindnessFeed reserves the right, where lawful and appropriate, to review reported and other on-platform communications, restrict or stop contact, hide, redact, remove or retain messages for investigation, suspend access and cooperate with competent authorities. Moderation access is limited to authorised personnel and subject to the Privacy Policy and applicable law. KindnessFeed does not guarantee the safety, accuracy or legitimacy of any user or charity communication.

Private communications, reporting and moderation

Members and organisations are responsible for the messages, representations, requests and commitments they make through KindnessFeed. KindnessFeed does not independently verify every communication and is not a party to arrangements made between users. Nothing in these Terms excludes or limits liability where prohibited by applicable law, or reduces statutory consumer rights.

KindnessFeed may provide reporting tools and may review platform communications, including message history and supporting context, for trust and safety, abuse prevention, regulatory compliance and dispute investigation. Access is restricted to authorised platform personnel and handled under the Privacy Policy and applicable data-protection laws. Users should not assume that on-platform messages are end-to-end encrypted or inaccessible to authorised moderators.

Where reasonably appropriate and lawful, KindnessFeed may hide, redact, remove or preserve messages; limit contact between particular accounts; suspend messaging or accounts across the service; and refer serious concerns to competent authorities. Decisions may take account of severity, context and the rights of affected users. Users may contact KindnessFeed to seek review of a moderation decision. Removal from the visible interface does not necessarily erase retained evidence or records required by law.

Messages and reports may contain sensitive personal information. Please share only what is necessary. Reports are not forwarded to the reported user as a standard practice; confidentiality cannot be guaranteed where disclosure is legally required. KindnessFeed does not guarantee that it will proactively monitor every message or prevent all harmful communications.

1. Who operates KindnessFeed

KindnessFeed is operated by [FULL LEGAL ENTITY NAME], registered in [JURISDICTION] under [REGISTRATION / TAX NUMBER], with its registered address at [REGISTERED ADDRESS]. Contact: [LEGAL CONTACT EMAIL].

2. What the service does

KindnessFeed helps individuals discover, follow and engage with charities and charitable organisations. Registered charities may publish posts, opportunities and links after verification. Certain features, including donations, supporter-data sharing, advertising and team management, may be introduced in later releases and will be subject to additional disclosures where relevant.

3. Acceptance of these terms and platform rules

By selecting the registration acceptance checkbox and creating an account, you confirm that you have read and agree to these Terms, the Community Rules referenced here, and the account rules applicable to your role. This agreement does not waive rights that cannot lawfully be waived. Acceptance of the Terms is separate from any optional marketing consent or consent to share personal data with a particular charity. [LINK TO COMMUNITY RULES TO BE ADDED].

4. Accounts and security

You must provide accurate registration information, keep your credentials confidential, and promptly notify us of suspected unauthorised access. You may only create an organisation account if you are authorised to represent that organisation. Additional representatives may be given role-based permissions after appropriate approval. Accounts may be suspended where necessary to protect users, investigate misuse, or comply with law, subject to applicable notice and review rights.

5. Verification of charitable organisations

Charity applications are subject to manual verification against appropriate official sources and confirmation of representative authority. A verified badge indicates that checks were completed at a point in time; it does not guarantee a charity’s effectiveness, content, financial condition or fundraising outcomes. We may request updates and withdraw verification where justified.

6. Content responsibility and community rules

Users and organisations are responsible for content they submit and must have the rights and permissions needed to publish it. Content must not be unlawful, fraudulent, misleading, defamatory, discriminatory, infringe intellectual property or expose another person’s private information without a lawful basis. Registered charities are responsible for the accuracy of their claims, fundraising information, offers and external links. KindnessFeed may moderate content under published rules, receive reports and provide reasons and remedies as required by applicable law, including the EU Digital Services Act.

7. Charity links, donations and third parties

Unless and until KindnessFeed expressly states that a payment feature has launched, donation links lead to the charity’s or payment provider’s separate service. Each charity and third-party operator remains responsible for its own transactions, policies and services. KindnessFeed’s intended policy is not to take a commission from charitable donations; any future processing charges or commercial relationships must be transparently disclosed before use.

8. Privacy and marketing choices

Personal-data processing is described in the Privacy Policy. Following or viewing a charity does not automatically authorise sharing a supporter’s personal information with it. Marketing preferences and any charity-specific data-sharing consent must be freely chosen and can be withdrawn through the relevant controls, once available. Users retain all rights under applicable data protection law.

9. Platform availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability, that every third-party link will function, or that user-created material is always accurate. Material changes to the Terms or service will be communicated appropriately. We will not use this clause to avoid obligations imposed by law.

10. Responsibility and liability

To the extent permitted by applicable law, KindnessFeed is not responsible for losses arising solely from the independent acts, omissions, statements or services of charities or unrelated third parties over which it has no legal responsibility. Nothing in these Terms excludes or restricts liability for our own unlawful conduct, intentional wrongdoing, gross negligence where exclusion is prohibited, data-protection breaches for which we are legally responsible, or any other liability that applicable law does not permit us to exclude. Consumer statutory rights remain unaffected.

Acceptable use and community comments

KindnessFeed is intended for respectful, lawful discussion and genuine charitable engagement. Users must not post harassment, threats, hate speech, discriminatory abuse, sexually explicit or exploitative material, scams, misleading fundraising claims, unsolicited advertising, malicious links, personal information shared without authority, or content infringing another person’s rights. Criticism, disagreement and good-faith discussion are permitted.

Every post and comment may be reported. Where a report indicates a potential breach, the content may be temporarily hidden while an authorised moderator reviews it. Moderators may restore content, remove it, issue warnings, limit posting privileges or suspend accounts, applying these rules consistently and proportionately. A report alone does not establish wrongdoing. Users will be given explanations and appropriate opportunities to challenge moderation decisions as required by applicable law, including the EU Digital Services Act.

KindnessFeed retains discretion to moderate content that reasonably undermines the safety, integrity or charitable purpose of the platform, subject to applicable law. We cannot guarantee that every post is accurate or lawful, and nothing in these terms removes our statutory responsibilities.

Account suspension, disabling and bans

KindnessFeed may, at its reasonable discretion, immediately restrict, suspend, disable or permanently ban an account where we reasonably believe its use breaches these Terms or Community Rules, threatens users or platform security, involves fraud or abuse, or creates legal or operational risks. We may take urgent protective action without advance warning or an opportunity to correct the breach. We may also restrict an organisation’s authorised users or withdraw a verified status where justified. Our decisions will be proportionate and consistent with applicable law.

Where required by law, including applicable provisions of the EU Digital Services Act, we will provide a statement of reasons and access to relevant complaint or appeal procedures. We do not promise advance notice in every case. Nothing in these Terms excludes mandatory user rights or our legal duties.

Ban appeals and conditional reinstatement

A user whose account has been suspended, disabled or banned may submit an appeal using the Appeal Ban link on the KindnessFeed website. Appeals will be assessed by authorised administrators, who may uphold, amend or reverse the decision based on the circumstances, evidence and our Community Rules. Reinstatement is not guaranteed; however, any statutory rights to contest moderation decisions and any required review procedures remain unaffected.

If reinstatement is approved, KindnessFeed may impose proportionate, clearly communicated conditions during a trial period, such as closer moderation of public posts and comments, temporary posting limits or additional account reviews. Any monitoring will be limited to what is necessary and lawful, with appropriate privacy safeguards. Repeated or serious breaches may result in renewed restrictions or a permanent ban, subject to applicable law.

Platform integrity and administrator discretion

KindnessFeed is committed to maintaining an open, fair, respectful and comfortable environment for individual users, charities and other participating organisations. To protect the integrity of the platform, prevent harassment or disruptive conflict, safeguard members and uphold our Community Rules, authorised administrators may, where reasonably justified, block, restrict, disable, suspend, prohibit access to or permanently ban any individual or charity account. This may include limiting posting, commenting or other platform privileges, and withdrawing organisation verification.

Administrators may act immediately and without advance notice where appropriate to address serious misconduct, risks to users or the platform, or repeated rule violations. Decisions must be made fairly, proportionately and consistently, without unlawful discrimination or retaliation for lawful criticism. Affected users may use the published Appeal Ban process, and any mandatory statement-of-reasons, complaint-handling, review or other rights under applicable EU and national law remain unaffected.

Conflicting causes, sensitive topics and harmful content

KindnessFeed welcomes charities and supporters with differing missions, beliefs and perspectives. Users and organisations must not use the platform to harass, intimidate, demean or target others, provoke hostility between groups, or interfere with another organisation’s lawful activities. Administrators may restrict, hide or remove posts and comments, and take proportionate account action, where content reasonably threatens community safety or undermines a respectful and inclusive environment.

Prohibited or restricted material may include promotion of violent extremism or terrorism; threats or glorification of violence; racist, ageist or other discriminatory abuse; degrading or derogatory attacks; encouragement or instruction of suicide or self-harm; coercive or psychologically abusive content; targeted religious or political harassment; incitement to hatred; and other unlawful, exploitative, threatening or seriously disruptive material. Content promoting unwelcome commercial solicitations, scams or misleading fundraising claims may also be removed.

Lawful political or religious views, charitable advocacy, respectful criticism, discussion of difficult subjects and evidence-based information about mental health or suicide are not prohibited solely because others disagree or find them upsetting. Moderation will consider context, likely harm and applicable law, and will be applied without unlawful prejudice or discrimination. Where necessary, authorised administrators may act without advance notice. Decisions remain subject to applicable transparency, complaint, appeal and review obligations.

Charities with opposing viewpoints

KindnessFeed may host charitable organisations whose missions, opinions or advocacy positions conflict. Each organisation may present its own cause, express lawful opinions, respond to criticism and participate in respectful debate. However, organisations and their representatives must not use KindnessFeed to target another charity or its supporters with personal abuse, harassment, threats, dehumanising statements, discriminatory attacks or coordinated intimidation.

Where interactions between organisations become hostile or disruptive, authorised administrators may moderate or remove posts and comments, restrict interaction between accounts, suspend privileges or, for serious or repeated breaches, suspend or ban an organisation. These measures will be based on conduct and risk, not on favouring one lawful political, national, religious or charitable viewpoint over another. Admins will seek to act impartially, consistently and proportionately, taking context into account. Immediate measures may be taken when warranted, subject to applicable legal obligations and appeal rights.

11. Governing law and jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Spain. To the extent permitted by applicable law, disputes arising from use of KindnessFeed shall be submitted to the competent courts of Spain. Nothing in these Terms limits or excludes mandatory rights or protections under European Union law, including consumer and data-protection legislation. Where applicable law grants a consumer the right to bring proceedings before the courts of their country of residence, that right remains unaffected.

12. Complaints, unlawful content and contact

To report illegal content, impersonation, fraud, misuse or another problem, contact [MODERATION CONTACT / REPORTING FORM]. We will handle notices and account restrictions in line with applicable rules. For questions about these Terms, contact [LEGAL CONTACT EMAIL].

13. Effective date and changes

Effective date: [TO BE CONFIRMED AFTER LEGAL REVIEW]. Last updated: [TO BE CONFIRMED]. Versions and acceptance records will be maintained when the service goes live.
